When you visit our website, our server temporarily stores each access. The following data is collected without your intervention:

Unless otherwise stated in this privacy policy, we will only use the aforementioned data to process the contract, specifically to process your orders, deliver the ordered products, and ensure correct payment. After the contract has been fulfilled, we will only store the data for as long as legally required or necessary to protect our legitimate interests (e.g., to assert legal claims).

Information is generally provided free of charge. If you request additional copies, a reasonable fee may be charged. However, the right to a copy of the processed data must not infringe upon the rights and freedoms of other individuals.

In the case of obviously unfounded or excessive requests, we reserve the right to refuse to provide information within the framework of legal requirements or to charge a fee for it.

Your application will generally be processed within 30 days. Should processing take longer due to complexity or a high volume of requests, the deadline may be extended by up to two additional months. In this case, you will be informed of the extension and the reasons for it within one month.

We employ appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
When you register with us as a customer, access to your customer account is only possible after entering your personal password. You should always keep your payment information confidential and log out of your online account and close the browser window after your session, especially if you share the computer with others.

General terms and conditions of business

These General Terms and Conditions (hereinafter "GTC") apply to all services and products offered by KAYND. The customer's general terms and conditions apply only if they have been expressly accepted by KAYND in writing. Amendments to these GTC are also invalid unless accepted by KAYND in writing.

KAYND is a brand of Andrea Seiler AG. Customers receive a written offer from KAYND via email or verbally by telephone or in the showroom. These Terms and Conditions form an integral part of the offer. The contract between KAYND and the customer is concluded when the customer accepts the offer in writing via email or verbally. KAYND typically confirms the concluded purchase agreement by sending an order confirmation via email. Even if the customer does not receive an order confirmation from KAYND for technical or other reasons, the purchase agreement is still considered concluded. The order confirmation, together with these Terms and Conditions, constitutes the binding description of the order and supersedes any previous offers and any other individual agreements.

KAYND products are sold according to samples, illustrations, or sketches. Minor variations in size, color, texture, and workmanship are possible. In particular, certain variations may occur with subsequent or supplementary orders placed at different times.

KAYND provides a statutory warranty against defects in design and materials for a period of two years from the date of delivery of the product to the customer. The customer must inspect the products immediately upon receipt for any defects. Any complaints must be made without delay, but no later than three days after receipt of a product. Defects that appear later, i.e., during the two-year warranty period, must be reported to KAYND immediately upon discovery. KAYND does not provide any further warranties or guarantees, in particular manufacturer's warranties. Excluded from the warranty are minimal deviations due to material and/or production-related factors, such as the slightest irregularities in the surface or dimensional differences in the millimeter range. Also explicitly excluded are damages caused by wear and tear, aging, and improper handling, as well as naturally occurring color changes due to light and other environmental influences, including light sources. Furthermore, the warranty is void if the customer continues to process or modify products despite recognizable defects.

KAYND reserves the right to remedy defects covered by the warranty and reported in a timely manner. Claims for rescission or price reduction are excluded. However, KAYND is also entitled to fulfill the warranty by providing an equivalent replacement product or refunding the purchase price; the customer has no legal entitlement to this.

Discounted products, especially those from the showroom, are generally sold "as is," deviating from the above provisions. This will be agreed upon with the customer during the purchase process. KAYND provides no warranties whatsoever for these products.

The delivery date and details for product collection will be agreed upon between the customer and KAYND. Deliveries are made to addresses in Switzerland and Liechtenstein. International orders are also possible by individual arrangement, in which case the customer and KAYND will agree on who is responsible for the export formalities. The customer bears any additional export costs.

Collection takes place at the showroom at Hinterbergstrasse 15 in 6330 Cham. As soon as the goods are ready for collection, the customer will be informed of the available collection times or a collection appointment will be arranged.

Any delivery date communicated by KAYND is approximate and subject to the supplier's adherence to their delivery schedule. The product is usually made available or delivered by the agreed delivery date. The customer will be notified if a product is affected by delivery delays or is temporarily unavailable. A delivery delay does not entitle the customer to withdraw from the contract, refuse acceptance of the goods, or claim damages.

Should KAYND be unable to receive delivery from its suppliers through no fault of its own, KAYND may unilaterally withdraw from the contract. The customer will be informed immediately of the unavailability, and any payments already made will be refunded to the customer in the event of withdrawal.

KAYND's product prices generally do not include delivery, unpacking, assembly or other services.

Agreed-upon product deliveries are made by contracted transport companies, our own employees, by mail, or by courier service. If delivery to the customer's address is agreed upon, it is generally made to the apartment, provided that local and structural conditions allow this with normal, foreseeable effort. The customer is responsible for ensuring that access to the delivery location is suitable for the transport of the ordered products. This includes, in particular, sufficiently wide doors, stairwells, and elevators.

If additional equipment (e.g., a facade lift) is required for delivery, or if there are special circumstances affecting delivery (e.g., poor access, long walks from the parking lot to the front door, narrow or obstructed stairwells, small lift), the customer must inform KAYND immediately after ordering the products and well in advance of the delivery date. The customer will bear any additional costs incurred due to extra expenses for delivery.

If installation has been agreed upon, it will only be carried out to the extent that the structural conditions allow it with reasonable effort. Lighting fixtures and electrical installations are excluded from installation unless explicitly agreed upon in writing.

The customer is responsible for ensuring that the structural and technical requirements for delivery and installation of the products are met. This includes, in particular, load-bearing walls or ceilings and suitable electrical connections.

KAYND accepts no liability for direct, indirect and/or consequential damages or delays resulting from unsuitable structural conditions.

KAYND offers its clients consulting services in the field of interior design and architecture on an hourly basis or at a fixed price. The exact services and price are agreed upon individually with the client.
Before production or ordering of custom-made products, the client receives an order confirmation. Afterward, changes are generally no longer possible or may result in additional costs and adjustments to delivery dates.

All copyrights and intellectual property rights to plans, drawings, drafts, designs and other documents created as part of a consultation (hereinafter referred to as "documents") contained in the order confirmation remain with KAYND or Andrea Seiler AG.

Upon request, the customer will receive a printed copy as well as electronic files of the documents and may use them for private purposes. Commercial use or distribution to third parties is not permitted without the prior written consent of KAYND.

KAYND is entitled to use the documents or modifications thereof for other clients. Furthermore, KAYND is entitled to use the documents in anonymized form as a reference in advertising materials, on websites, or in social media. References containing a client's personal information will only be used after prior consultation.
If mirrors, furniture, or other items are individually designed or created for a client, all intellectual property rights (in particular copyright and design rights) to these designs remain with KAYND or Andrea Seiler AG.

KAYND is not obliged to permanently retain the documents after completion of an order.

Agreed prices are generally quoted in Swiss francs (including VAT unless otherwise stated). Prices in euros are possible if explicitly agreed upon.

Discounts and vouchers are only accepted under the specified conditions. Discount or voucher codes must be entered during the order process. Discounts or vouchers not used during this process cannot be applied retroactively.

Unless otherwise agreed, a 100% prepayment is due for each order within three days of receiving the invoice. Products purchased directly from our showroom must be paid for in full on-site before collection or delivery. A late payment fee of 5% of the agreed purchase price will be charged starting with the second reminder.

Until full payment of the purchase price, products remain the sole property of KAYND. KAYND is entitled, at the customer's expense, to register a reservation of title if the claim is deemed to be at risk.

KAYND reserves the right to assign or pledge to third parties any outstanding price claims against a customer arising in connection with our services, including any outstanding installments, default interest and reminder fees.

Exchanges or returns of products are excluded unless expressly agreed otherwise.

For in-store pickup, the customer must collect the product within 14 days of being notified of its arrival. If the customer fails to accept a product on the agreed delivery date, KAYND is entitled to immediately invoice any remaining balance of the agreed purchase price. From the initial delivery attempt until the product is actually delivered, KAYND is entitled to charge storage fees. In the case of storage, the warranty period begins automatically after the first delivery attempt. If delivery is not possible within three weeks of the first delivery attempt, KAYND is entitled to continue charging storage fees or to sell the product elsewhere and invoice the customer for any price difference as well as a handling fee of CHF 400.

If the customer withdraws prematurely before a completed consulting assignment, he must indemnify KAYND and pay the costs incurred up to his written declaration of withdrawal (including expenses, outlays and supplier costs).

Personal data is processed in accordance with KAYND's current privacy policy . This policy is available on the website and forms an integral part of these terms and conditions.

All cases of breach of contract and their legal consequences, as well as all claims by the customer, regardless of their legal basis, are conclusively governed by these Terms and Conditions. Other claims by the customer – irrespective of their legal basis – are excluded, except as specified in these Terms and Conditions. KAYND is not liable for damages that did not occur to the products themselves, in particular not for consequential damages, lost profits, or other financial losses. The foregoing limitation of liability does not apply in cases of injury to life, body, or health; in cases of intentional or grossly negligent breach of duty; in cases of warranty promises, insofar as agreed; and to the extent that the Product Liability Act applies.

Furthermore, KAYND is not liable for delays or the non-performance of contractual obligations if these are due to circumstances beyond KAYND's control. These include, in particular, supply bottlenecks at manufacturers or suppliers, transport disruptions, natural disasters, pandemics, acts of war, government actions, or other cases of force majeure.

Should individual provisions of these terms and conditions be or become wholly or partially invalid, the remaining provisions shall remain unaffected.

Swiss law applies exclusively. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. The exclusive place of jurisdiction is Zug, subject to any mandatory places of jurisdiction stipulated by applicable law.

The information presented online is non-binding. We reserve the right to modify the product range and its presentation at any time and to remove certain products entirely from the range. We exclude all liability for typographical errors, incorrect or incomplete information and representations.

Decorative items shown in connection with a product are not included in the product offer unless explicitly listed and mentioned. Accessories and decorative items must be purchased separately.

We strive to ensure the best possible availability of the products offered on the website. The contract is only valid for those products that are expressly listed in the order confirmation. This also definitively determines the scope of services.

Our offers are valid for Switzerland and Liechtenstein. For orders with delivery addresses outside of Switzerland and Liechtenstein, the stated delivery prices and shipping fees are invalid. KAYND accepts the payment methods displayed to the buyer during the ordering process.

The purchase price and any applicable shipping costs will be charged after order confirmation. For credit card payments, the relevant amount will be blocked or reserved at the time of order placement. However, the actual charge will still occur upon our order confirmation.

Discounts or vouchers are only accepted under the conditions stated on the voucher. Voucher codes or values ​​are entered during the payment process. Discounts not applied during this process cannot be granted retroactively. Discounts cannot be combined.

There is no right of return unless expressly agreed otherwise.
